A man who held police at bay for nearly nine hours has been charged with murder over the death of a “good Samaritan”.

Jonathon Sporton, 21, was charged with one count of murder overnight on Tuesday and remanded, but chose not to appear in the Melbourne Magistrates Court on Wednesday to answer the charge.

Family members of both Mr Sportan and the victim were in court.

Prosecutor Guillaume Bailin successfully applied for an extension to serve the hand-up brief to Mr Sporton’s lawyers, saying that there were a significant number of witnesses to be interviewed and CCTV footage to be formatted because the alleged murder occurred in a public place.

Greg Thomas, for Mr Sporton, said there were no custody management issues.

Mr Sporton was arrested after an almost nine-hour siege in Altona North beginning about 2am on Tuesday.

Mr Sporton, of Carlton North, had been on the run for more than a day after a stranger to him, 46-year-old Altona North man Roger Bertocci, was stabbed to death at a busy Altona North intersection.

Detectives previously said they believed the victim had attempted to intervene when he saw a man fighting with his pregnant girlfriend on Blackshaws Road on Sunday afternoon.

“He stopped, left his vehicle and has approached the two and was fatally stabbed as a result,” Detective Senior Sergeant Stuart Bailey said on Tuesday.

Passers-by had performed CPR on Mr Bertocci before paramedics arrived, but he died at the scene.

Mr Bertocci, a warehouse worker who left behind a wife and two young daughters, has been described as a loving father and “a down-to-earth family guy.”

“He loved his family, absolutely loved his family. His two daughters and his wife were everything to him,” the man’s colleague Nicole Waymouth said.

“He would come in weekly with a video or some sort of story to tell us about his youngest daughter, or older daughter…

“He was just a really down-to-earth family guy, he was straight up, he was a very hard worker.

“He was one of the nice guys.”

Homicide Squad Detective Senior Sergeant Stuart Bailey said on Tuesday that Mr Sporton’s girlfriend, 24, was not injured or taken hostage, but was assisting him in the stand-off. She was assessed by paramedics at the scene and later taken to St Kilda Road police station.

Mr Sporton will appear in court again on April 30 for a committal mention hearing.
